I - GENERAL TERMS AND CONDITIONS for using the Sincommerce website and web shop
In accordance with the Consumer Protection Law (“Official Gazette of Montenegro” no. 002/14, 006/14, 043/15, 070/17, 067/19, 146/21), purchasing through our website Sincommerce.me is considered distance selling.
1. Please read this Agreement carefully. By accessing and using this website or any part of it, or any service available through the "Sincommerce" website, you agree to the Terms and Conditions outlined below, and this Agreement will be considered signed. This Agreement is concluded between Sincommerce d.o.o and the user.
II – DEFINITIONS

3. If you register with us for services and comply with the provisions of this Agreement, you can receive assistance in using services and purchasing products from the "Sincommerce" online store.

5. We reserve the right to modify these terms and conditions at any time. All amendments and updates will be published online on the web shop: prod.sincommerce.me. You, as the user, may cancel this Agreement via written document (by mail or email at info@sincommerce.me) if you do not agree to the new terms and conditions. However, continuing to use the service or website will be considered acceptance of the new terms.
III - WEBSITE AND SERVICES
1. Application of terms: Use of the services and website is subject to the terms and conditions stated in this Agreement.
2. Age: To use the web shop and/or service (with or without registration), you must be 18 years or older.
3. Usage location: The web shop and the service of purchasing and home delivery are currently directed exclusively at those accessing our web shop from Montenegro.
4. Equipment and connection: To use the website and/or services, you need to provide computer equipment and an internet connection. We are not responsible for telecommunications costs or any other expenses that may arise from using our web shop.
5. Registration: You can use our web shop without registration; however, by registering for the services, you will be able to use more functionalities of our website. We reserve the right to refuse new registrations or cancel existing registrations at any time.
IV - GENERAL RULES FOR USING THE "Sincommerce" SERVICES AND WEBSITE
1. We do not guarantee that the web shop will operate without errors and take no responsibility for any errors or omissions. In case of a service error, it should be reported via email to: shop@sincommerce.me
2. We do not guarantee that your use of the services or web shop will be uninterrupted or that all information received through the service or web shop will always be timely, accurate, and reliable.
3. We have taken all technical measures to ensure your security on the Sincommerce web shop, but we do not guarantee that using our services or web shop will not expose your computer to viruses or other unwanted effects caused by computer technology.
4. We have implemented all necessary technical actions and measures to ensure smooth service operation, but we do not guarantee that access to the service and/or web shop will not have interruptions, and therefore, our service may be suspended, restricted, or terminated at any time.
5. We reserve the right to modify, replace, suspend, or remove any information or service on the web shop without notice. Your access to the web shop and/or services may also be temporarily restricted due to maintenance, servicing, or the introduction of new content or services. Such interruptions will last as briefly as possible.
6. We assume no responsibility for the content or services of any other website or service linked to our web shop.
7. We assume no responsibility for the functionality of your web browser.
8. We reserve the right to block access and/or edit or remove any material that violates any clause of this agreement or the business interests of any partner, supplier, or advertiser.
V - VIOLATIONS OF RULES
1. If you or someone else, with your permission, uses the web shop or service in violation of this Agreement, we may suspend the use of certain services and/or the web shop (in whole or in part).
2. If we suspend the use of the service or web shop once, we may permanently refuse re-use of the service or web shop, or possibly reinstate access only after receiving a written guarantee from you that there will be no further violations of this Agreement.

IX - DELIVERY AND POSSIBLE COMPLAINTS
1. The "Sincommerce" web shop delivers goods within Montenegro.
2. Ordered goods will be sorted approximately as categorized on the web shop and packed for transport to prevent damage during regular handling.
3. Ordered goods will be delivered within the time frame defined in the proforma invoice, depending on the value, weight, number of packages, distance, and place of delivery from the moment of ordering.
4. Delivery is charged according to the valid price list clearly displayed on the page where you select the delivery time.
5. If a product is missing from the order, the order will be delivered without that product and will not be charged.
X - COMPLAINTS / RETURNS
1. The buyer is required to check the contents of the delivery upon receipt and in case of any errors or damage to the goods, immediately report it to the delivery person. Do not accept goods with visible external damage. If you are not satisfied with the ordered item, you may return it, but a report must be made stating the reason for the return. Reasons for returning goods include damaged packaging and an inadequate product. In the case of returning defective and/or damaged goods, the invoice amount will be reduced on-site by the cost of the returned item.
In the case of a refund to a customer who has previously paid using one of the payment cards, either partially or in full, and regardless of the reason for the refund, the refund is carried out exclusively via the same VISA, Maestro, or MasterCard card that was used for the payment. This means that our bank will process the refund to the cardholder's account upon our request.
2. Upon receiving the shipment, please check your package in the presence of the courier. If the package has been damaged during transport, such damages will be visible upon receipt. In such cases, we kindly ask you not to accept the package. Please contact us as soon as possible so that we can verify the condition of the shipment and send you a replacement.
If you have received the shipment and later discovered that the delivered goods are damaged, do not match the order, or the invoice details are incorrect, please contact us as soon as possible.
You can submit your complaint in writing via email to info@sincommerce.me or deliver it to the address Ćemovsko polje, Podgorica, Montenegro. When filing a complaint, you must complete the Contract Termination Form. You can download the form here. We will respond to your complaint as soon as possible and inform you about the next steps. The consumer is required to return the goods without delay, but no later than 14 days from the date of notifying the seller about the contract termination decision. The return must be made exclusively via the same courier service that initially delivered the package, as directed by the seller.
In the event of unilateral contract termination, the consumer is responsible for covering the return shipping costs.
If you wish to file a complaint about a purchased product that is found to be defective under the provisions of the Consumer Protection Law, please complete the complaint form and submit it along with a photo of the defect to the email address info@sincommerce.me
The consumer does not have the right to file a complaint if they exceed the 90-day complaint period from the date of purchase, if the defect occurred due to their own or others’ actions, if they purchased the product at a discounted price due to a defect, if the item was bought during a clearance sale, or if they simply changed their mind about the product.
Once our complaint resolution committee makes a decision, no later than 8 days in accordance with the Consumer Protection Law, we will inform you about the next steps regarding your complaint.
A report will be compiled with the complaint, including the customer's remarks and the requested resolution. The customer has the right to choose whether they want the item to be repaired, replaced, or refunded, which will be recorded in the report. The report is made in two copies, one of which is sent to the customer. If repair or replacement is not possible, the customer has the right to request an appropriate price reduction or contract termination.
Subsequent product complaints are processed as warranty or actual defect claims and must be sent to the Service Provider via email at info@sincommerce.me or delivered to the address Ćemovsko polje, Podgorica, Montenegro.
XI - PAYMENT
1. Orders can be paid in cash upon delivery, via bank transfer (to a bank account through commercial banks or Montenegro Post), or online using credit cards, subject to the following limitation: The Sincommerce web shop accepts MasterCard, Maestro, and Visa credit cards that are approved for online payments by the issuing bank.
Payment for products in our online store can be made using one of the following methods: payment cards - VISA, Maestro, or MasterCard, which support online payments. Card payments are processed securely through AllSecure doo and HIPOTEKARNA BANKA AD PODGORICA using the AllSecure Payment Gateway, where card details are simply entered.
Once card details are entered and the payment is confirmed, the bank authorizes the transaction, and the order is approved for further processing. The amount will be reserved on your card (account) and will not be available for other uses.
The transaction will be completed and the amount deducted from your account once the products are prepared for shipping and handed over to the courier service. If the payment is not completed, and the amount is not deducted from the account within 14 days of order acceptance, the order will be canceled and deleted. After the 14-day period expires, the reserved funds will be released and made available to you again. You may then place the same or a new order and complete the payment.
Please check with the issuing bank to ensure that your card supports online payments.
2. The payer is responsible for the payment of products, i.e., the transaction and transfer of funds to Sincommerce doo.
3. Using the web shop is currently free for all visitors. Sincommerce doo reserves the right to charge for certain services in the future that were previously free. You will always be notified in advance of any changes before incurring any charges.
XII - PAYMENT CONVERSION STATEMENT
All payments will be made in euros (€). If payment is made using credit cards issued by foreign banks, the transaction amount will be converted to the cardholder’s local currency based on the exchange rate of Visa/Mastercard.
XIII - CREDIT CARD PAYMENT SECURITY
When entering credit card details, confidential information is transmitted over a secure (encrypted) connection using SSL protocol, modern tokenization methods for sensitive data, and in compliance with PCI-DSS standards. The payment processor guarantees transaction security. At no time are credit card details available to the merchant.
